Letters testamentary

Letters testamentary is the document a probate court issues to the executor named in a will, formally granting them legal authority to act on the estate's behalf, including signing documents like a listing agreement or a deed. Without it, a title company will generally not accept the executor's signature as valid.

Why it matters

A title company will want to see this document before it accepts anyone's signature as the seller of an estate's house.
