What Tennessee law means here.

These four facts apply the same way in every Tennessee county. Sourced from the state code or the courts.

Foreclosure
Non-judicial. Almost every Tennessee mortgage is a deed of trust with a power-of-sale clause, so a lender forecloses after 20 days of published notice rather than filing a lawsuit.Source: Tenn. Code Ann. Title 35, Ch. 5
Recordation tax
A realty transfer tax of 37 cents per $100 of the sale price (or the property's value, if greater), collected as part of the county's recordation tax. The law puts it on the buyer (the grantee), though a purchase contract can shift it to the seller.Source: Tenn. Code Ann. § 67-4-409, TN Dept. of Revenue: Recordation Taxes
Seller disclosure
Required. A seller of a one-to-four-unit residential property must give the buyer a signed property disclosure statement, or a disclaimer statement if the buyer agrees to waive it.Source: Tenn. Code Ann. §§ 66-5-201 to 213
Tax sale redemption
After a court confirms a delinquent tax sale, the former owner (or any other interested party) has one year from that order to redeem the property: paying the delinquent taxes, penalty, interest, court costs and 12% annual interest on the purchase price. There is no redemption after that year runs.Source: Tenn. Code Ann. § 67-5-2701

Inherited or in probate.

A house that passed through inheritance in Roane County usually has to clear probate before a sale can close, unless it was already held in a trust or passed by survivorship. Probate here is handled by Roane County Clerk and Master, Chancery Court. We work with executors, administrators and heirs at any stage of that process.

Nothing on this page is legal or tax advice. An estate attorney is the right call for anything specific to a filing.
